1. ACCEPTANCE OF TERMS

By accessing or using the website vividmindswellness.com or any services provided by Vivid Minds Wellness LLC ("Vivid Minds Wellness," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use this website or our services.

2. ELIGIBILITY

You must be 21 years of age or older to use our services. By booking a session or using our website, you represent and warrant that you meet this age requirement. Our services are available only to individuals located in Colorado in accordance with Colorado Proposition 122 and the Natural Medicine Health Act.

3. NATURE OF SERVICES

Vivid Minds Wellness is a state-licensed psilocybin healing center operating under Colorado Proposition 122 and License NMHC-00003. Our services include facilitated psilocybin sessions, yoga, breathwork, and art therapy sessions. We do not provide medical treatment, diagnosis, psychotherapy, or mental health services. Our facilitators are licensed natural medicine facilitators, not physicians or licensed therapists unless otherwise stated.

4. HEALTH SCREENING AND CLIENT RESPONSIBILITY

All clients are required to complete a health intake screening prior to participating in a session. You are responsible for providing accurate and complete health information. Vivid Minds Wellness reserves the right to decline service to any individual based on health screening results in accordance with state regulations.

5. BOOKING, CANCELLATION, AND REFUNDS

Sessions must be booked in advance through our online booking system. Cancellations made more than 48 hours before a session start time will receive a full credit toward a future session. Cancellations within 48 hours of a session are non-refundable. No-shows forfeit the full session fee. Private One-on-One Journey sessions require a minimum of 72 hours notice for cancellation.

6. CONDUCT AND SAFETY

Clients are expected to arrive sober and in compliance with all pre-session preparation guidelines. Vivid Minds Wellness reserves the right to refuse service or remove any client from a session who poses a risk to themselves or others, without refund.

7. INTELLECTUAL PROPERTY

All content on this website including text, images, graphics, logos, and session materials is the property of Vivid Minds Wellness LLC and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or use any content from this site without prior written permission.

8. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Vivid Minds Wellness LLC, its owners, facilitators, and staff shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services or website. Our total liability to you for any claim shall not exceed the amount you paid for the session giving rise to the claim.

9. DISCLAIMER

Psilocybin-assisted healing is not a substitute for medical treatment or licensed psychotherapy. Results vary by individual. Vivid Minds Wellness makes no guarantees regarding outcomes from any session.

10. GOVERNING LAW

These Terms of Service are governed by the laws of the State of Colorado. Any disputes shall be resolved in the courts of Denver County, Colorado.

11. CHANGES TO TERMS

We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Continued use of the site or services after changes are posted constitutes acceptance of the revised terms.
